裏口入学について
【合肥/中国 11日 AFP】中国中部、安徽（Anhui）省の合肥（Hefei）で11日、大学案内などが行われる高等教育フェアが開催された。最近の大学入試では約950万人が受験し、記録的な人数の入学が見込まれている。中国の厳しい雇用市場において、学士号はもはや良い就職口を保証するものではなくなってきている。写真は、高等教育フェアに設置された大学のブース。(c)AFP
６月７、８日が中国の国立大学入学試験だそうですが、
この翌日日本で、京都裏口入学斡旋失敗和解事件・・が発覚しました。
中国でも大学側を巻き込んでの裏口入学騒動があるようで・・。
〇概要
京都市内の女性が私大医学部推薦入試受験の息子のために７６０万円を予備校に支払ったが不合格になったらしいんですが。経営者は、「裏口入学工作のために資金を受け取った、それは母親から持ちかけられた。大学側に５３０万円払い推薦入試の問題文を入手したからちゃんと裏口入学の努力をした」、というような供述をしています。（大新聞ソースまま！）一方、母親は「合格させてあげる、と大学側から持ちかけられた、運動資金として５００万円払い、その後さらに２６０万円払った」、と供述してますね。
〇替え玉受験さえ・・
要するに、普通に行われていることなんですね。入学前の寄付金集めとか禁止されてるし、当然捕まるケースもありますが。中国でも２００１年に上海の一流大の裏口入学リストがネット流出した事件があったそうですが、個人的には詳細は知りません。ま正直、そういう人はいっぺん死んだらいいと思いますよ。（笑）・・だってなんでもありでしょう？こういう裏経済を志向する属性の小金持ちがなんと多いことか、といろいろな取材をしていると思いますね。
あと、替え玉受験、なんていうのもあるんですよ。バイト感覚の一流大の学生を雇ってそういう仕事をしている業者にも会ったことがありますが（本人確認も切り抜けてきたそうだ。）、それはここでは置いておいて、古くは1917年（大正6年）の春、中学・高校・高専で替え玉受験が急増したそうです。２，３年前にも都内の都立高校で替え玉が発覚した事件がありました。父親が単独で頼んだそうです。母親が知らなくて、学校側と話して発覚、入学は未遂に終わったそうなのですが。あと一時期ネットにもそういう業者ありましたね・・。子を思う歪んだ親心・・でしょうね、それにつけこむ輩がいる、というよりはそっちが問題だと思いますねえ。
〇法的には・・
これは、答案が、「事実証明に関する文書」（私文書偽造罪・159条）に当たる（判例）んですね。そして当然文書の性質的に自著性が要求されますから、作成名義の偽りのみ問われる私文書偽造罪にあっても、受験者の名前がちゃんと書いてあったって私文書偽造罪が成立する、と。逆に言えば、ただの私文書偽造罪なんですね。
大学側だって訴えないんですよ。イメージが悪くなるだけだから。
♪人生はゲーム～誰も自分を～愛しているだけのかなしいゲームさ～、っていう古い歌があるんですけれども（笑）、受験ってそういう人間の暗部が現われやすいものかもしれません。
